My property offer information is based on the information I have provided or the information provided by third parties (e.g. owner, landlord, authorized representative). In spite of my own care, I expressly assume no liability for their correctness and completeness. All information must be checked before the contract is concluded, also with the help of experts commissioned by you, such as architects and building experts. The offers are free and non-binding. The right to prior sale, leasing and rental is expressly reserved. My offers and communications are intended exclusively for you, the addressee, and must be treated confidentially. A transfer to third parties requires our prior written consent. If a contract is concluded as a result of unauthorized disclosure to third parties, even in part, you are obliged to pay compensation in the amount of the lost commission. You acknowledge that I have proven the property to you first if you do not inform me immediately and in writing, stating the source of the information, that you were already familiar with the property or that it was offered by another party. The establishment of contacts with regard to the objects I have proven, e.g. to the respective owner and landlord, always means placing an order and recognizing my terms and conditions. If, on the basis of my evidence and / or our brokerage activity, other contracts such as a purchase or rental agreement are concluded or the property is acquired in a foreclosure auction, you will have to pay a commission. Unless otherwise agreed and in a binding written form, my commission is 5 percent plus statutory VAT of the purchase price. When renting out to owners (residential properties) 2 monthly cold rents, in the commercial area from tenants 3 monthly cold rents, each plus statutory VAT. Due and payable upon conclusion of the contract. Upon signing the reservation agreement, a one-off expense allowance of € 2,000 will be made. If the buyer withdraws from the reservation agreement, the expense allowance remains with MS Immobilien. In all other cases, e.g. the conclusion of the notarized purchase contract, this expense allowance is offset against the broker's commission. New regulations for the distribution of brokerage fees from December 23rd, 2020 The new "Act on the distribution of brokerage costs when brokering sales contracts for apartments, single-family houses and single-family houses with separate apartments. The law thus regulates the half commission sharing between seller and buyer and is thus uniformly regulated nationwide. If there is a contract for an object on offer, please leave me a copy of the contract and the individual terms and conditions. A commission claim also exists if the contract was concluded on terms that differ from my offers, e.g. in the case of a foreclosure auction. If an object offered by me is offered to you again later, either directly or through a third party, you are obliged to assert the previous knowledge I have gained from the provider and to reject any third-party brokerage services with regard to our properties. Our terms and conditions are part of all contracts and objects offered with you. Invalidity of individual conditions does not affect the validity of the remaining agreements. MS Real Estate
